The B2C website is intended primarily for individual travellers and customers booking services for personal or private travel.

B2B customers, travel agents, tour operators and other businesses may use a separate dedicated booking platform and account system subject to separate commercial terms.

A customer must not use a B2C account or B2C booking system for unauthorized resale, commercial redistribution or other B2B activity unless expressly permitted by Fixed Tour.

4. ELIGIBILITY

You must provide accurate information when using our website or making a booking.

You are responsible for ensuring that:

  • the information provided during booking is accurate;
  • you are authorized to use the payment method used;
  • you have authority to accept these Terms;
  • the passenger information is correct;
  • the pickup and drop-off information is correct;
  • the travel date and service time are correct; and
  • all passengers comply with applicable laws and service requirements.

Where a booking is made on behalf of another person or group, the person making the booking is responsible for communicating the relevant booking information and applicable Terms to all travellers.

5. BOOKING PROCESS

The normal booking process is:

Service selection → Payment → Booking request → Backend/supplier confirmation → Voucher/booking confirmation.

Submitting a booking and making payment does not necessarily mean that the requested service has already been confirmed.

A booking becomes confirmed only when Fixed Tour and/or the applicable service provider has confirmed the service and the customer receives the applicable booking confirmation or voucher.

We may contact you if additional information is required to complete or confirm your booking.

6. PAYMENT

Fixed Tour may accept payment through different payment methods and payment service providers, including, where available:

  • Credit and debit cards;
  • Stripe;
  • PayPal;
  • Bank transfer;
  • Other payment gateways or payment methods displayed during checkout.

Available payment methods may vary according to the customer's country, currency, service and other circumstances.

Payments may be processed by third-party payment providers. Their terms and privacy policies may also apply to the processing of the payment.

7. CURRENCIES, PRICES AND FEES

Prices may be displayed in USD and/or other supported currencies.

The applicable currency and total amount payable will be displayed during the booking process.

Where applicable, the checkout may separately identify charges such as:

  • Service price;
  • Platform or booking fee;
  • Payment gateway or processing fee;
  • Government or statutory charges;
  • Taxes;
  • Local charges; and
  • Other applicable fees.

The customer will be shown the applicable charges before completing payment, subject to any correction required for an obvious pricing or technical error.

The customer is responsible for reviewing the final booking amount before submitting payment.

8. BOOKING CONFIRMATION

After payment, Fixed Tour will process the booking request and seek confirmation from the applicable backend team and/or service provider.

If the requested service is available and confirmed, a confirmation and/or voucher will be issued.

If the requested service cannot be confirmed, Fixed Tour may:

  1. offer an alternative service;
  2. offer a different time, vehicle or arrangement where reasonably possible; or
  3. where an alternative is not accepted or cannot reasonably be provided, refund the applicable amount paid for the unconfirmed service, subject to the applicable payment and refund process.

A supplier's inability to confirm a service does not automatically create an entitlement to compensation beyond the amount applicable to the affected booking unless required by applicable law.

9. VOUCHERS AND BOOKING DOCUMENTS

Customers must review their booking confirmation and voucher immediately after receiving them.

The customer is responsible for checking:

  • Passenger names;
  • Number of passengers;
  • Date;
  • Time;
  • Pickup location;
  • Drop-off location;
  • Flight or train information, where applicable;
  • Vehicle/service type;
  • Included services;
  • Meeting point;
  • Special instructions; and
  • Any applicable cancellation or service conditions.

Any apparent error should be reported to Fixed Tour as soon as possible.

10. CANCELLATION AND REFUND POLICY

Unless a different cancellation policy is expressly displayed on the applicable product or booking page, bookings are generally non-refundable and non-changeable.

This may include:

  • Customer cancellation;
  • Change of travel plans;
  • Change of date;
  • Change of time;
  • Change of passenger numbers;
  • Failure to use the booked service;
  • Customer no-show;
  • Late arrival by the customer;
  • Missed service;
  • Failure to attend a tour;
  • Failure to reach the pickup point on time; or
  • Other customer-related reasons.

Where a product has a specific cancellation or refund policy displayed during booking, that product-specific policy will apply.

Nothing in these Terms is intended to remove any mandatory refund or consumer rights that cannot legally be excluded under applicable law.

11. NO-SHOW

A customer may be treated as a no-show if the customer or passenger:

  • does not appear at the specified pickup or meeting point;
  • is not available within the applicable waiting period;
  • cannot be contacted using the information provided;
  • arrives after the service has departed;
  • provides incorrect pickup information;
  • goes to the wrong meeting point; or
  • otherwise fails to use the service at the booked time.

Unless otherwise stated in the applicable booking conditions or required by law, a no-show booking is non-refundable.

12. BOOKING CHANGES AND CORRECTIONS

Customers may contact Fixed Tour through available customer support channels, including chat or email, to request basic corrections or updates.

Examples may include:

  • Passenger name spelling correction;
  • Contact information correction;
  • Minor booking information correction;
  • Other basic administrative updates.

A requested change is not guaranteed.

Changes may be subject to:

  • Supplier approval;
  • Availability;
  • Additional charges;
  • Ticketing restrictions;
  • Operational limitations; or
  • The specific conditions of the booked service.

A request to change a booking does not automatically change the booking.

The booking remains subject to its original conditions until Fixed Tour confirms the requested change in writing or through the applicable booking system.

13. TRANSFER SERVICES

Fixed Tour may provide or arrange both private and shared/SIC transportation services.

Depending on the product, vehicles may include cars, SUVs, vans, minibuses, coaches or other suitable vehicles.

Unless a specific vehicle brand, model, colour or exact vehicle is expressly guaranteed in writing, Fixed Tour or the supplier may provide a suitable equivalent vehicle based on passenger numbers, luggage, availability and operational requirements.

For shared/SIC services, passengers may travel with other customers and may be subject to designated pickup points, routes and schedules.

For private services, the vehicle is generally reserved for the booked passenger/group, subject to the specific product conditions.

14. TOURS AND ACTIVITIES

Tours may be offered as:

  • Guided tours;
  • Self-guided tours;
  • Driver-only tours;
  • Private tours;
  • Shared/SIC tours; or
  • Other arrangements described on the product page.

The itinerary, duration, inclusions, exclusions, meeting point, tickets and other conditions may differ between products.

Customers must carefully review the product description and booking conditions before payment.

The order of sightseeing or individual itinerary points may change due to traffic, weather, operational requirements, attraction opening hours, local restrictions or other circumstances.

Where an attraction, activity or service becomes unavailable, Fixed Tour or the applicable supplier may provide an alternative where reasonably possible.

15. VEHICLE RENTAL AND CHAUFFEUR SERVICES

Vehicle rental and chauffeur services are subject to the conditions displayed for the relevant service.

Customers may be required to provide valid identification, driving documents, licenses, payment information, deposits or other documentation where applicable.

For chauffeur services, the chauffeur is responsible for providing the transportation service described in the booking.

Customers must comply with reasonable safety instructions and applicable local laws.

Any prohibited, unsafe or unlawful use of a vehicle may result in termination of the service without refund, subject to applicable law.

16. THIRD-PARTY SUPPLIERS

Some services are operated or fulfilled by independent local suppliers, transportation companies, guides, activity operators, attraction operators, chauffeurs or other service providers.

Fixed Tour may act as the booking platform, arranger, intermediary or contracting party depending on the applicable service and booking structure.

Third-party suppliers may have their own operational rules, safety requirements, age restrictions, cancellation conditions and service limitations.

Customers agree to comply with reasonable instructions and requirements of the applicable supplier.

Where required by law, Fixed Tour's responsibility will be determined according to the role it has in the relevant transaction and applicable law.

17. CUSTOMER RESPONSIBILITIES

Customers are responsible for:

  • Providing accurate booking information;
  • Providing correct pickup and drop-off details;
  • Providing correct passenger information;
  • Arriving at the required location on time;
  • Following the instructions provided with the booking;
  • Following reasonable instructions from drivers, guides and suppliers;
  • Complying with local laws and regulations;
  • Ensuring passengers are fit and able to use the booked service safely;
  • Supervising children and minors in their group;
  • Keeping personal belongings secure; and
  • Obtaining all required travel documents.

Customers must not intentionally provide false or misleading information.

18. PASSPORTS, VISAS AND TRAVEL DOCUMENTS

Fixed Tour does not provide visa or immigration services unless a specific service is expressly stated otherwise.

Customers are solely responsible for obtaining and maintaining:

  • Valid passports;
  • Required visas;
  • Entry permissions;
  • Transit permissions;
  • Travel documents;
  • Health or vaccination documentation where legally required; and
  • Any other documents required for their journey.

A customer's inability to obtain a visa, entry permission or other required travel document does not automatically create a right to a refund where the applicable booking is non-refundable.

Customers should verify requirements with the relevant government authorities before travelling.

19. PERSONAL BELONGINGS AND LUGGAGE

Customers are responsible for their own luggage, personal belongings, documents, money, electronics and other possessions.

Customers should not leave valuables unattended in vehicles, at meeting points, attractions or other locations.

Fixed Tour and/or the applicable supplier is not responsible for lost, stolen, damaged or forgotten belongings except to the extent liability is imposed by applicable law.

Luggage restrictions may apply depending on the vehicle or service.

Customers must provide accurate information regarding luggage where requested during booking.

20. DELAYS, TRAFFIC AND OPERATIONAL CONDITIONS

Travel services can be affected by circumstances outside Fixed Tour's reasonable control, including:

  • Traffic congestion;
  • Road closures;
  • Accidents;
  • Weather;
  • Public events;
  • Local restrictions;
  • Construction;
  • Delays at airports or stations;
  • Security restrictions;
  • Supplier operational issues; or
  • Other unforeseen circumstances.

Fixed Tour will make reasonable efforts to assist customers where operationally possible.

However, Fixed Tour does not guarantee that a transportation service will be unaffected by traffic, delays or other circumstances outside its reasonable control.

Customers should allow sufficient travel time when connecting to flights, trains, cruises, attractions or other time-sensitive arrangements.

21. FLIGHT, TRAIN AND TRANSPORT DELAYS

Where a booking depends on an arriving flight, train, cruise or other transportation service, customers must provide accurate information where requested.

Any flight or transportation monitoring, if offered, will be subject to the conditions of the applicable service.

A delay or cancellation of a customer's flight, train, cruise or other transportation does not automatically entitle the customer to a refund for a non-refundable booking.

Where reasonably possible, Fixed Tour may attempt to assist with an operational change, subject to availability and any applicable additional charges.

22. CHANGES BY FIXED TOUR OR SUPPLIER

In exceptional circumstances, Fixed Tour or the applicable supplier may need to change:

  • Vehicle type;
  • Driver;
  • Guide;
  • Meeting point;
  • Route;
  • Tour sequence;
  • Service timing;
  • Supplier; or
  • Other operational details.

Where possible, the replacement service will be of comparable nature and value.

If a material change cannot reasonably be avoided and the customer is legally entitled to a refund or other remedy, Fixed Tour will provide the applicable remedy required by the booking terms and applicable law.

23. CANCELLATION BY FIXED TOUR OR SUPPLIER

Fixed Tour or the applicable supplier may cancel a service where necessary because of:

  • Operational circumstances;
  • Safety concerns;
  • Supplier unavailability;
  • Government restrictions;
  • Attraction closure;
  • Severe weather;
  • Force majeure;
  • Incorrect or fraudulent booking information;
  • Payment problems; or
  • Other circumstances making the service unavailable or unsafe.

Where a service is cancelled by Fixed Tour or the supplier and an alternative cannot reasonably be provided, Fixed Tour may provide an applicable refund or other remedy in accordance with the booking conditions and applicable law.

24. FORCE MAJEURE

Fixed Tour will not be responsible for failure or delay in providing services caused by circumstances beyond its reasonable control.

Such circumstances may include:

  • Natural disasters;
  • Earthquakes;
  • Floods;
  • Severe weather;
  • Epidemics or pandemics;
  • War;
  • Terrorism;
  • Civil unrest;
  • Government action;
  • Strikes;
  • Transport disruption;
  • Road closures;
  • Major accidents;
  • Security restrictions;
  • Attraction closures; or
  • Other extraordinary events beyond reasonable control.

Where such circumstances occur, Fixed Tour will make reasonable efforts to assist customers, but the availability of refunds, alternatives or other remedies will depend on the applicable booking conditions, supplier terms and applicable law.

25. FRAUD, UNAUTHORIZED PAYMENTS AND CHARGEBACKS

Customers must only use a payment method that they are legally authorized to use.

The person making the booking is responsible for ensuring that the payment method belongs to them or that they have authorization from the payment-method holder.

Where Fixed Tour reasonably believes that a payment, booking, payment dispute or chargeback is fraudulent, unauthorized, abusive or otherwise improper, Fixed Tour may:

  • Suspend or cancel the booking;
  • Suspend or restrict the customer's account;
  • Withhold further services where legally permitted;
  • Provide information to payment providers or relevant authorities;
  • Seek recovery of amounts legitimately owed; and
  • Take legal action where appropriate and permitted by applicable law.

A customer should contact Fixed Tour before initiating a payment dispute concerning a booking so that Fixed Tour has an opportunity to investigate and resolve the issue.

Nothing in this section limits any rights the customer may have under applicable payment, consumer or other mandatory laws.

26. LIABILITY

Fixed Tour will provide its services with reasonable care consistent with the nature of the service and applicable law.

To the maximum extent permitted by applicable law, Fixed Tour will not be responsible for losses caused by:

  • Customer actions or omissions;
  • Incorrect information supplied by the customer;
  • Customer no-show;
  • Customer lateness;
  • Failure to possess required travel documents;
  • Loss or theft of personal belongings;
  • Events outside Fixed Tour's reasonable control;
  • Independent supplier actions where Fixed Tour is not legally responsible for those actions; or
  • Indirect or consequential losses where such exclusion is legally permitted.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including any liability that applicable law prohibits a business from excluding.

27. PERSONAL INJURY AND SAFETY

Customers must follow reasonable safety instructions provided by drivers, guides, activity operators and other service providers.

Customers must inform Fixed Tour or the relevant supplier of any important requirements or limitations that may materially affect the safe provision of the service.

Certain activities may involve inherent risks. Customers should review the product description and applicable safety requirements before booking.

Nothing in these Terms excludes liability for death or personal injury where such liability cannot legally be excluded.

28. COMPLAINTS AND CUSTOMER SUPPORT

If a customer experiences an issue during a service, the customer should contact Fixed Tour or the applicable supplier as soon as reasonably possible.

This gives Fixed Tour and/or the supplier an opportunity to investigate and, where possible, resolve the issue while the service is taking place.

Customers may contact Fixed Tour through the support channels displayed on the website, including email, chat or other available communication methods.

For complaints after completion of a service, customers should provide relevant booking information and supporting documents where applicable.

29. WEBSITE ACCOUNTS

Where account registration is available, customers are responsible for maintaining the confidentiality of their login credentials.

Customers must not:

  • Share account credentials improperly;
  • Create accounts using false information;
  • Access another customer's account;
  • Use the website for fraudulent purposes;
  • Attempt to interfere with website operation;
  • Use automated systems to abuse the booking platform;
  • Scrape or reproduce website content without permission; or
  • Use the website for unlawful purposes.

Fixed Tour may suspend or terminate an account where there is a reasonable basis to believe that the account is being used fraudulently, unlawfully or in violation of these Terms.

30. WEBSITE CONTENT AND AVAILABILITY

Fixed Tour aims to keep website information accurate and current.

However, prices, availability, photographs, itineraries, vehicle information, operating hours and other information may change.

We do not guarantee that the website will always be available, uninterrupted or error-free.

We may update, modify, suspend or discontinue parts of the website or booking platform when reasonably necessary.

31. INTELLECTUAL PROPERTY

The Fixed Tour name, brand, logo, website design, text, graphics, software, photographs and other original website content are owned by or licensed to Fixed Tour and are protected by applicable intellectual-property laws.

Customers may use the website for legitimate personal booking purposes.

Customers may not copy, reproduce, distribute, modify, commercially exploit or republish Fixed Tour content without prior written permission, except where permitted by applicable law.

32. PRIVACY

Fixed Tour collects and processes customer information in accordance with its applicable Privacy Policy.

The Privacy Policy explains how personal information may be collected, used, stored and shared in connection with bookings, payments, customer support and service delivery.

By using Fixed Tour services, customers acknowledge that their information may need to be shared with relevant suppliers, payment processors, transportation operators, guides or other service providers where necessary to fulfil the booking and as permitted by applicable law.

The Fixed Tour website may contain links, payment services, maps, communication tools or other services operated by third parties.

Fixed Tour is not responsible for the content, availability, policies or practices of third-party websites or services except where required by applicable law.

Customers should review the relevant third-party terms and privacy policies where appropriate.

34. PROMOTIONS AND DISCOUNTS

Promotional codes, discounts and special offers may be subject to additional conditions.

Unless expressly stated otherwise:

  • Promotions cannot be exchanged for cash;
  • Promotions may be limited to specific products;
  • Promotions may have an expiry date;

  • Fixed Tour may withdraw or modify a promotion where reasonably necessary.

Any promotion obtained through fraud, misuse or unauthorized means may be cancelled.

35. MODIFICATIONS TO THESE TERMS

Fixed Tour may update these Terms from time to time.

The latest version will be published on the Fixed Tour website with the applicable effective date.

Changes will generally apply to future bookings.

The Terms applicable to an existing booking will normally be the Terms accepted at the time of booking, except where an update is required by law or otherwise permitted under the applicable agreement.

36. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally permitted.

The remaining provisions will continue to apply to the extent permitted by law.

37. NO WAIVER

If Fixed Tour does not immediately enforce a provision of these Terms, that does not mean that Fixed Tour has waived its right to enforce that provision later.

38. GOVERNING LAW AND DISPUTES

Except where mandatory law provides otherwise, these Terms and the contractual relationship between the customer and the applicable Fixed Tour contracting entity will be governed by the laws applicable to that contracting entity and, where applicable and legally permissible, the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

Where a booking is contracted through a different Fixed Tour entity or where mandatory consumer laws apply in the customer's country or destination, those mandatory laws may apply notwithstanding this section.

Any dispute will be handled through the courts or other dispute-resolution mechanism having lawful jurisdiction over the applicable parties and transaction.

Nothing in this section is intended to deprive a consumer of mandatory rights or remedies available under the laws that apply to the consumer.

39. ENTIRE AGREEMENT

These Terms, together with the applicable booking details, product-specific conditions, cancellation policy, Privacy Policy and any other conditions expressly incorporated into the booking, constitute the agreement relating to the customer's use of the relevant Fixed Tour service.
